Drafting Consulting Contracts To Get You Paid

Any consulting agreement has an element of risk. For consultants, one of the greatest risks is not getting paid.

When payment terms are unclear or in dispute, the consequences can be severe. Our financial security may be at risk, our profitability may suffer, and our attention is diverted from revenue-generating activities. Having a well-crafted consulting contract in place is therefore essential for consulting success.

Our May speaker is San Jose attorney Jonathan Sweet, who works with small businesses. A return speaker to PATCA on contract issues, Jonathan will discuss these contract clauses that can have a substantial impact on getting paid:

Speaker
Jonathan J. Sweet, Esq.

Jonathan J. Sweet is a practicing litigation and transactional attorney in San Jose, CA who has achieved the Martindale-Hubbell AV rating – the highest rating possible. Sweet regularly represents small businesses with drafting and negotiating contracts, and with civil litigation. He also serves as a mediator and arbitrator for companies with contract disputes.

Sweet is the author of two law books: Sweet on Construction Industry Contracts / Major AIA Documents (now in its fourth edition), and Avoiding or Minimizing Construction Litigation. Sweet has been a regular lecturer for Lorman Education Services since 2002, speaking on a variety of legal subjects. He taught at the University of San Francisco School of Law, San Jose State University, and Lincoln Law School of San Jose. He received his B.A. from the University of California, Berkeley, and his J.D. Degree from the University of San Francisco. Sweet has served as an arbitrator and Judge Pro Tem for the Santa Clara County Superior Court, and he is a member of IEEE CNSV and other industry groups.
